1. Acceptance of Terms
By creating an account or using ACTIV KODE ("we", "us", "our", or the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
You confirm that you are at least 18 years old and legally capable of entering into a binding contract in your jurisdiction.
2. Description of Service
ACTIV KODE provides rental of virtual phone numbers and email addresses for receiving one-time SMS and email verification codes ("OTPs") from third-party online services. The service is prepaid: you top up a balance using cryptocurrency, then spend the balance on individual rentals.
Each rental:
- Is for a single verification code, unless explicitly stated otherwise
- Has a time limit (typically 20 minutes for SMS, 20 minutes for email)
- Is automatically refunded to your balance if no code is received in time
3. Acceptable Use
You agree to use the Service only for lawful purposes. You must NOT use the Service to:
- Commit fraud, identity theft, money laundering, or any other crime
- Bypass security or anti-fraud measures of any third-party service in violation of their terms
- Send spam, harass, threaten, or harm any person
- Violate intellectual property, privacy, or other rights of third parties
- Distribute malware, viruses, or any harmful code
- Resell, sublicense, or commercially redistribute access to the Service without our written permission
We reserve the right to suspend or terminate accounts engaged in prohibited activities, without refund, and to report violations to law enforcement.
4. Account Registration
You must provide a valid email address and a secure password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at contact@activkode.com if you suspect unauthorized access.
You may create only one account per person. We may refuse, suspend, or terminate any account at our discretion.
5. Payment and Balance
Top-ups are processed in cryptocurrency via NOWPayments. The balance is denominated in USD. Conversion rates are determined at the time of payment by NOWPayments.
All sales are final, except as set out in our Refund Policy.
Balance is non-transferable, non-redeemable for cash (except as required by law), and expires if your account is inactive for 12 consecutive months.
6. Service Availability
We strive for 99% uptime but make no guarantees. The Service depends on third-party providers (telecom operators, email service providers, payment processors), and outages outside our control are possible. We are not liable for:
- SMS delays caused by carrier networks
- Codes blocked by third-party services that detect virtual numbers
- Number ranges blacklisted by specific platforms
- Crypto network congestion delays
7. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- Codes will always arrive within a given timeframe
- Any specific service will accept virtual numbers
8. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to these Terms or the Service is limited to the amount you paid us in the last 90 days, or USD $100, whichever is greater.
We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages of any kind, including lost profits, lost data, business interruption, or loss of goodwill.
9. Indemnification
You agree to defend, indemnify, and hold harmless ACTIV KODE, its officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; (d) any content you submit.
10. Changes to Terms
We may modify these Terms at any time. Material changes will be announced via email or a notice on the Service at least 7 days before taking effect. Continued use after changes constitutes acceptance.
11. Termination
You may terminate your account at any time by emailing contact@activkode.com. We may suspend or terminate your account for breach of these Terms, suspected fraud, or any reason at our discretion. Upon termination, your balance is forfeited unless we owe you a refund under the Refund Policy.
12. Governing Law and Disputes
These Terms are governed by the laws of the European Union and the country where ACTIV KODE is established. Any dispute will first be submitted to good-faith negotiation. If unresolved within 30 days, disputes will be settled by binding arbitration or competent courts of that jurisdiction.
13. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
